Welcome to GlowGuide Inc. ("Platform"). This Terms of Service Agreement ("Agreement") governs your access to and use of our Platform. By accessing or using our Platform, you agree to be bound by this Agreement and our Privacy Policy, which is incorporated by reference.
"Platform" refers to our software application, website, and services designed to track medical aesthetic treatments and match users with healthcare providers.
"User" refers to any individual who accesses or uses the Platform.
"Provider" refers to any medical aesthetic professional, physician, or healthcare organization listed on the Platform.
"Content" refers to all information, text, data, images, and other materials available on the Platform.
Our Platform offers the following services:
NOT MEDICAL ADVICE: The Platform is intended for informational purposes only. The content, tools, and services provided through our Platform are not substitutes for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition or treatment.
NO DOCTOR-PATIENT RELATIONSHIP: The use of our Platform does not create a doctor-patient relationship between you and the Platform. Any communication with Providers through our Platform does not establish a doctor-patient relationship until expressly established by the Provider according to applicable laws and professional standards.
We make reasonable efforts to ensure Provider information is accurate, but we cannot guarantee the accuracy, completeness, or reliability of any Provider information. Users should independently verify Provider credentials, qualifications, and licensing status before receiving any treatments.
TREATMENT OUTCOMES: We are not responsible for any outcomes, side effects, complications, or results of any treatments or procedures you receive from Providers matched or found through our Platform. All medical decisions, treatments, and procedures are solely between you and your chosen healthcare Provider.
PROVIDER ACTIONS: We are not liable for the actions, inactions, negligence, or malpractice of any Providers you connect with through our Platform. Any claims related to treatment should be directed to the Provider who performed the treatment.
HIPAA COMPLIANCE: Our Platform is designed to comply with the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and its implementing regulations. We maintain appropriate administrative, technical, and physical safeguards to protect the privacy and security of your protected health information ("PHI") as required by HIPAA.
DATA COLLECTION AND USE: We collect and use your personal information as described in our Privacy Policy. By using our Platform, you consent to such collection and use of your information.
DATA SECURITY: While we implement reasonable security measures to protect your information, no system can guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.
As a User of our Platform, you agree to:
All content, features, and functionality of our Platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of our company or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
We reserve the right to terminate or suspend your access to the Platform at any time, without notice, for conduct that we believe violates this Agreement or is harmful to other Users, Providers, us, or third parties, or for any other reason at our sole discretion.
We may modify this Agreement at any time. We will provide notice of any material changes by posting the updated terms on our Platform. Your continued use of the Platform after such changes constitutes your acceptance of the revised Agreement.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, agents, and licensors from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement by you or any activity related to your account.
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any principles of conflicts of law.
Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration conducted in Delaware in accordance with the rules of the American Arbitration Association.
If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us regarding the use of the Platform.
